These Website Terms govern your use of mitchbrownphotofreediving.com. The website is operated by Mitch Brown Photo LLC, doing business as Mitch Brown Photo Freediving ("Mitch Brown Photo Freediving," "we," "us," or "our").
By using this website, you agree to these Website Terms. Separate terms may apply to a booking, payment, course, photography session, certification, participant waiver, medical statement, or photography release. If a separate written agreement conflicts with these Website Terms concerning the booked activity, the separate agreement controls for that activity.
1. Website information
We make reasonable efforts to keep course descriptions, schedules, prices, certification requirements, locations, and other information accurate. However, conditions, availability, training standards, prices, and schedules may change.
Website content is general information and is not medical, legal, safety, or emergency advice. Contact us before booking if you need confirmation of a detail that is important to your participation or travel plans.
2. Bookings and payments
Bookings may be processed through the booking and payment providers identified on the applicable website. A booking is not confirmed until the applicable booking system accepts it and provides confirmation.
Prices are displayed in United States dollars unless stated otherwise. The amount and terms shown during checkout control if they differ from an outdated price displayed elsewhere on the website.
You are responsible for providing accurate contact, eligibility, participant, and payment information.
3. Participation requirements
Freediving is a physically and mentally demanding recreational activity conducted in and around water. Participation may require:
- Satisfactory completion of a medical statement or health questionnaire.
- Medical clearance when an answer or condition requires it.
- Completion of a participant agreement, acknowledgment of risk, or written release.
- Completion of any prerequisite certification or experience requirement.
- Compliance with age and guardian-consent requirements.
- Demonstration of required swimming or water-comfort skills.
- Compliance with instructor directions and safety procedures.
We may decline, pause, modify, or end participation when reasonably necessary for safety, weather, ocean conditions, eligibility, conduct, equipment, staffing, or compliance with course standards.
4. Minors
A parent or legal guardian must make or authorize a booking for a participant under 18 and complete all required consent and participant documents. Additional minimum-age rules may apply to particular AIDA courses or activities.
5. Certification and performance
Course enrollment does not guarantee certification, a particular depth, a particular breath-hold time, or any other performance outcome.
Certification is awarded only after all applicable theory, confined-water, open-water, safety, rescue, and performance requirements are successfully completed.
Maximum course depths are limits, not goals. Actual depth and exercise participation are determined according to training standards, conditions, instructor judgment, and the participant's readiness.
6. Safety and inherent risks
Freediving, swimming, boating, ocean activities, and underwater photography involve inherent risks. These can include breath-hold injury, loss of motor control, blackout, drowning, pressure-related injury, marine life, waves, currents, weather, boats, equipment problems, slips, falls, and delayed emergency response.
The presence of an instructor or safety procedures cannot eliminate every risk.
Participants must follow safety instructions, disclose information reasonably necessary to assess participation, use required equipment, and never practice freediving alone.
This website notice is not the participant's written waiver or release. Required participant documents are provided separately during or after booking.
7. Medical information
Nothing on this website is medical advice. Consult an appropriately qualified medical professional concerning your fitness to freedive, particularly if you have a medical condition, use medication, are pregnant, have recently been ill or injured, or have concerns about pressure exposure or breath-hold activity.
Do not disregard professional medical advice because of information on this website.
8. Weather, ocean conditions, and changes
Ocean activities depend on weather, visibility, currents, marine conditions, harbor operations, vessel availability, and other circumstances outside our control.
We may change the meeting point, training site, sequence of activities, schedule, or date when reasonably necessary. We may postpone or cancel an activity when conditions are unsuitable or participation cannot be conducted safely.

9. Third-party services and links
The website may link to or display services operated by third parties. Those services may have separate terms, privacy policies, cancellation rules, and accessibility limitations.
We are not responsible for third-party website content or for a third party's independent acts or omissions, except where applicable law provides otherwise.
10. Intellectual property
Unless otherwise identified, the website's text, design, logo, photographs, videos, graphics, and other original material are owned by or licensed to Mitch Brown Photo LLC and are protected by applicable intellectual-property laws.
You may view the website and share ordinary links to its public pages. You may not reproduce, sell, modify, republish, scrape for commercial reuse, remove attribution from, or create commercial derivative works from website content without prior written permission.
A participant's rights to photographs produced during a purchased photography service are governed by the separate photography agreement or license supplied for that service.
11. Reviews, testimonials, and submitted material
A review or testimonial must reflect the author's honest experience. Submitting material does not automatically give us permission to use it in advertising.
We will obtain permission or rely on another lawful basis before publishing a customer photograph, testimonial, or other identifiable submitted material where permission is required.
Nothing in these Website Terms prohibits a customer from making an honest statement about our services or otherwise exercising a right protected by law.
12. Website availability and security
We may modify, suspend, or discontinue website features. We do not guarantee that the website will always be uninterrupted, error-free, or free from every harmful component.
You may not attempt to gain unauthorized access, interfere with the website, introduce malicious code, scrape the website in a manner that disrupts service, or use the website for unlawful activity.
13. Disclaimers and limitation
To the extent permitted by law, the website and its general informational content are provided without a promise that every item will always be complete, current, or suitable for every visitor.
Nothing in these Website Terms excludes or limits responsibility that cannot legally be excluded or limited. Nothing in these Website Terms excuses Mitch Brown Photo Freediving from exercising reasonable care or complying with duties imposed by applicable law.
14. Governing law
These Website Terms are governed by the laws of the State of Hawaii, without regard to conflict-of-law principles. Any dispute relating solely to use of this website will be handled in an appropriate court with jurisdiction in Hawaii, unless applicable law requires otherwise.
15. Changes
We may update these Website Terms. The revised version will be posted on this page with a new effective date. Changes do not retroactively alter an already confirmed booking unless the customer agrees or applicable law permits the change.
