Mitch Brown Photo LLC, doing business as Mitch Brown Photo Freediving ("Mitch Brown Photo Freediving," "we," "us," or "our"), respects your privacy. This Privacy Policy explains what information may be collected when you visit mitchbrownphotofreediving.com, contact us, book a course or photography session, or otherwise interact with our services.

1. Information we collect

Information you provide directly

We may receive information that you voluntarily provide when you:

  • Contact us by email, telephone, text message, social media, or another communication service.
  • Book a course, private-training session, or photography session.
  • Complete a participant form, waiver, medical questionnaire, certification record, or other document associated with a course or session.
  • Request information, customer support, a cancellation, a refund, or a schedule change.
  • Submit a review, testimonial, photograph, or other content with permission for us to use it.

Depending on the interaction, this information may include your name, email address, telephone number, booking details, course history, certification information, equipment needs, emergency-contact information, age or date of birth, payment status, and information relevant to your safe participation in freediving activities.

Please do not send sensitive medical information through ordinary email or text unless we specifically request it. When health or safety information is necessary, use the form or booking process provided for that purpose.

Information collected automatically

When you visit the website, Cloudflare, our web server, and other hosting or security providers may automatically receive limited technical information, including: your Internet Protocol address, browser and device type, operating system, the pages or files requested, the referring page, the date and time of the request, security, diagnostic, and error information.

This information may be recorded in ordinary server, network, or security logs. We use it to deliver the website, maintain security, diagnose technical problems, and prevent abuse.

Booking and payment information

Bookings are processed using the third-party booking service identified on the applicable website.

When you use an embedded booking calendar or follow a booking link, the booking provider may collect information directly from you under its own privacy policy. Payment-card and bank information is handled by the booking provider and its payment processors. Mitch Brown Photo Freediving does not receive or store your complete payment-card number.

The production website currently uses FareHarbor.

2. How we use information

We may use information to:

  • Answer questions and communicate with you.
  • Schedule, manage, modify, or cancel bookings.
  • Provide freediving instruction, private training, photography, and related services.
  • Determine course eligibility and help plan equipment, staffing, and safety arrangements.
  • Maintain training, certification, waiver, and business records.
  • Process payments, refunds, disputes, and accounting records.
  • Send service-related information, including confirmations, reminders, meeting instructions, weather notices, and schedule changes.
  • Protect participants, instructors, the website, and our business.
  • Detect fraud, misuse, security incidents, or technical problems.
  • Comply with legal, insurance, accounting, certification-agency, and safety obligations.
  • Use reviews, testimonials, or photographs when the person concerned has authorized their use or when their use is otherwise permitted by an applicable agreement.

We do not use health or safety information for advertising.

3. Cookies and similar technologies

Our website and its service providers may use cookies or similar technologies that are necessary to deliver website features, maintain security, remember booking-session information, or operate an embedded booking calendar.

We do not currently use advertising pixels or a dedicated website analytics service, and we do not use information from this website to create profiles for targeted advertising.

Third-party content and booking tools may set or access their own cookies when they load or when you interact with them. Those technologies are governed by the third party's own privacy policy and settings.

4. When information may be disclosed

We may disclose information to:

  • Booking, scheduling, payment, email, hosting, security, storage, and technical-service providers that help us operate the business.
  • AIDA International or another applicable training or certification organization when needed to register a student, verify training, or issue a certification.
  • Instructors, assistants, boat operators, facility operators, or other service providers when reasonably necessary to conduct your course or session safely.
  • Accountants, insurers, attorneys, and professional advisers.
  • Government authorities or other parties when disclosure is required by law, legal process, or a legitimate safety concern.
  • A successor or potential successor in connection with a merger, sale, reorganization, or transfer of the business, subject to appropriate confidentiality protections.

We do not sell personal information. We do not share personal information for cross-context behavioral advertising or targeted advertising.

5. Third-party services and links

The website may contain links to or embedded content from Cloudflare, the booking and payment provider identified on the applicable website, Google, AIDA International, Instagram, TikTok, and other external websites.

These organizations operate under their own privacy policies. We do not control their websites, cookies, security practices, or handling of information that you submit directly to them. You should review the privacy terms shown by the applicable provider before supplying information.

Google Fonts may be requested from Google when a page loads. This can disclose ordinary connection information, such as your Internet Protocol address and browser information, to Google.

The booking and payment provider used on this website is FareHarbor, and its privacy policy governs information you submit directly to it.

6. Data retention

We retain personal information only for as long as reasonably necessary for the purposes described in this policy, including providing services, maintaining certification and safety records, meeting tax, accounting, insurance, and legal requirements, resolving disputes, and enforcing agreements.

Retention periods vary according to the type of record and the reason it was collected. When information is no longer reasonably needed, we may delete it, anonymize it, or securely dispose of it.

7. Data security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no website, email system, electronic transmission, or storage method can be guaranteed to be completely secure.

Do not send payment-card numbers, Social Security numbers, passport numbers, or similarly sensitive information through ordinary email or text.

8. Your choices and requests

Subject to applicable law and reasonable identity verification, you may ask us to:

  • Tell you what personal information we maintain about you.
  • Correct inaccurate information.
  • Delete information that we are not legally or operationally required to retain.
  • Provide a copy of information you previously supplied.
  • Stop using a testimonial or photograph when your permission is the basis for its continued use.
  • Stop nonessential promotional communications.

You may designate an authorized agent where applicable law permits it. We may request proof of the agent's authority and verification of the identity of the person making the request.

We will not discriminate against you for making a privacy request. Some information may be retained when required for safety, certification, accounting, fraud prevention, legal compliance, dispute resolution, or another lawful purpose.

9. Do Not Track and Global Privacy Control

Some browsers offer "Do Not Track" signals. There is no universally accepted standard for responding to those signals, and this website does not currently respond differently when a Do Not Track signal is received.

We do not sell personal information or use it for cross-context behavioral advertising. If our practices change in a way that makes a legally recognized opt-out signal applicable, we will update our practices and this policy as required.

10. Children's privacy

This website is intended for a general audience and is not directed to children under 13. We do not knowingly collect personal information online directly from a child under 13 without legally sufficient permission.

A parent or legal guardian should make inquiries, complete bookings, and provide required information for a participant under 18. If you believe a child under 13 has provided personal information directly to us without appropriate permission, contact us at [email protected] so that we can review and, where appropriate, delete it.

11. Visitors from outside the United States

Mitch Brown Photo Freediving operates in Hawaii, United States. If you visit the website or book a service from another country, your information may be transferred to and processed in the United States, where privacy laws may differ from those in your location.

12. Changes to this policy

We may update this Privacy Policy when our services, providers, or legal obligations change. The revised policy will be posted on this page with an updated effective date. Material changes may also be communicated by another reasonable method when required.
