Cancellation and Refund Policy
Effective date: August 22, 2026
This policy applies to courses, private training, and photography sessions provided by Mitch Brown Photo LLC, doing business as Mitch Brown Photo Freediving.
The cancellation terms displayed and accepted during checkout form part of the booking. If checkout displays a cancellation term that conflicts with this policy, contact Mitch Brown Photo Freediving before completing the booking.
Customer cancellations
Cancellations made at least seven full calendar days before the course or session's scheduled start time are eligible for a 50% refund of the amount paid.
Cancellations made fewer than seven full calendar days before the scheduled start time are nonrefundable.
No-shows and cancellations made after a course or session has begun are nonrefundable.
Rescheduling
Contact us as early as possible if you need to change your booking. Rescheduling is subject to availability, instructor scheduling, course requirements, ocean conditions, and costs already incurred.
A request to reschedule is not automatically approved. Approval of a rescheduling request does not waive the cancellation policy for a later cancellation or change.
A rescheduling request made fewer than seven full calendar days before the scheduled start time does not automatically create a refund, credit, or right to move the booking to another date.
Late arrival
Participants are responsible for arriving at the confirmed meeting point at the confirmed time with the required equipment and documents.
A late arrival may result in shortened participation or loss of the booking when the activity cannot reasonably or safely be delayed. A missed or shortened activity caused by late arrival is nonrefundable.
Weather and ocean conditions
Rain alone does not necessarily cancel an ocean activity. Decisions are based on conditions relevant to safe instruction or photography, including wind, waves, currents, visibility, harbor operations, weather warnings, and site availability.
Mitch Brown Photo Freediving may change the training site, meeting point, sequence of activities, or schedule when reasonably necessary.
If Mitch Brown Photo Freediving cancels an activity because of conditions and cannot provide a reasonable replacement date, the customer will be offered a refund of the amount paid for the portion cancelled by Mitch Brown Photo Freediving.
Instructor or operational cancellation
If Mitch Brown Photo Freediving cancels an activity because of instructor unavailability, unsafe conditions, equipment failure, insufficient operational resources, or another operational reason, the customer will be offered a reasonable rescheduling option or a refund of the amount paid for the portion cancelled by Mitch Brown Photo Freediving.
Multi-day courses
A multi-day course is booked as one course. Missing a day, arriving late, voluntarily withdrawing, or being unable to continue after the course begins does not automatically create a refund right.
If Mitch Brown Photo Freediving cancels only part of a multi-day course, we will first attempt to reschedule the affected portion. If that is not reasonably possible, the customer will be offered a refund of the amount paid for the portion cancelled by Mitch Brown Photo Freediving.
Certification and personal performance
Payment covers instruction, supervision, and the booked course experience. It does not purchase or guarantee certification.
Failure to complete a certification requirement, reach a depth, complete a breath-hold, pass an examination, or satisfy another performance standard does not by itself create a refund right.
Medical conditions and eligibility
Customers are responsible for reviewing course prerequisites and completing required medical and participant forms truthfully.
If a medical answer requires professional clearance, participation may be delayed or denied until acceptable clearance is provided. Failure to obtain required clearance does not automatically override this cancellation policy.
Travel and third-party expenses
Mitch Brown Photo Freediving is not responsible for airfare, lodging, transportation, parking, meals, lost wages, or other travel or personal expenses arising from a cancellation, rescheduling, weather event, or course outcome, except where applicable law requires otherwise.
Consider refundable travel arrangements or appropriate travel insurance if you are traveling to Hawaii for a scheduled activity.
Refund processing
Approved refunds are calculated according to this policy. When a cancellation qualifies, 50% of the amount paid for the affected booking will be refunded through the original payment method or booking provider when reasonably possible.
Banks, card issuers, and the applicable booking or payment provider may require additional processing time after a refund is initiated.
How to request a cancellation or change

- The booking name.
- The scheduled course or session.
- The scheduled date.
- The requested cancellation or change.
- A telephone number where you can be reached.
A request is not complete until it has been received and acknowledged.
